We start with a general discussion of what trademarks are and how to get them, as well as a discussion of the differences between common law trademarks and registered trademarks. Then Charles shares his recent experience with a trademark dispute, and the effect that it had on the way he views trademarks. Next we consider the need to defend a trademark and the risk of a trademark becoming genericized. Finally, we take a look at the process of registering for a trademark in the U.S. and some of the things that should be kept in mind when registering.
